Allahabad High Court, in an important decision, canceled the order of the single bench to call the candidates for re-counselling for the remaining 12091 posts out of the advertisement issued on 30 November 2011 for the recruitment of 72,825 trainee teachers in Junior Basic Schools, considering it not correct. Have given. The Special Appellate Bench said that such counseling cannot be ordered after 13 years, whereas the Supreme Court has upheld the recruitment process of trainee teachers. The court has given this order while accepting the special appeal of the state government and the Basic Education Council in this matter.
On both the special appeals, the division bench of Justice Ashwani Kumar Mishra and Justice SQH Rizvi had reserved the decision after hearing for several days. The special appeal bench of the High Court, while giving its verdict on these appeals on Tuesday, accepted the special appeal of the government. In the special appeals filed against the order of the single bench by Additional Chief Standing Advocate Ramanand Pandey on behalf of the state government and Kushmanda Shahi on behalf of the Basic Education Council, it was said that the Supreme Court had on 25 July 2017 and later on behalf of the candidates in this matter. On December 13, 2019, in the contempt case filed against him, the contempt case was closed considering the completed recruitment of trainee teachers as correct. In such a situation, the instruction of the single bench to conduct re-counselling of the candidates on the remaining posts regarding 2011 recruitment is illegal.
On behalf of the candidates Vinay Kumar Pandey and others, it was said that there is no error in the order of the single bench. It was argued that the correct facts were not presented in the contempt case filed by the government in the Supreme Court. Due to which such an order was given and the Supreme Court considered the recruitment to be correct and ended the contempt case.
It is noteworthy that in the matter of recruitment of 72825 assistant teachers of Basic Education Council, the single bench of the High Court had directed that advertisement should be issued for counseling on the remaining 12091 posts in this recruitment and the result of counseling will be released by the last week of February. Let it be done. This order of the court was expected to put an end to this recruitment dispute that had been going on for almost 12 years. The lawyers of the petitioners said that as a result of the court order, out of the recruitment of 72825 assistant teachers, 66655 posts were selected and the selected candidates have also taken charge. But 12091 posts are still left, on which counseling was not conducted and the candidates falling within the selection limit could not be appointed.
The single bench had said that it is surprising that despite knowing about the counselling, the selected candidates did not participate in the counseling and remained engaged in the litigation. Whereas no facts related to counseling are on record. In such a situation, the State Government and the Basic Education Council should issue fresh advertisement for counseling on 12091 posts and those candidates falling in this category, who have not participated in counseling earlier, should be called. The single bench had said that the counseling should be conducted in the week starting from February 5, 2024.
