The High Court on Friday rejected the petitions challenging the Constable Appointment Rules-2014 of the Jharkhand Government. The court of Acting Chief Justice S Chandrashekhar and Justice Arun Kumar Rai, while rejecting the petitions, said that the government has the right to make appointment rules and amend them. The appointments made under the rules are valid. With this direction, the court dismissed all the petitions challenging the rules. 65 petitions were filed against the rules. After completing the hearing on the petition on March 15, the court had reserved its decision.

The applicants had filed a petition saying that the government had amended the constable appointment rules in the year 2014. This rule is against the provisions of the police manual. The condition of minimum qualifying marks prescribed for the written examination in the new rules is also wrong. Therefore the new rules should be repealed. Jharkhand Staff Selection Commission said that according to the new rules, advertisement was issued in the year 2015 for the appointment of constables and Jap soldiers in all the districts. The appointment process has been completed in the year 2018. On behalf of the government, it was said that making appointment rules and amending it is within the jurisdiction of the government.

The government makes new appointment rules and makes appointments accordingly. Same thing has happened in this case also. Therefore these petitions should not be heard. Earlier, during the hearing of the case, the court had given interim instructions saying that the appointment of 6800 constables as per the rules will be affected by the final order of this case. Along with this, the court had asked to make all the successful candidates defendants in this case. After this direction of the court, 4250 successful candidates had given their stand saying that the appointment rules are in accordance with the rules and the appointment process is as per the rules. Therefore the petitions should be rejected.
