The Supreme Court on Monday took up petitions related to the clash between two benches of the Calcutta High Court on the issue of getting the Central Bureau of Investigation (CBI) investigated into allegations of irregularities in issuing caste certificates to candidates seeking reserved category seats of MBBS. The apex court bench had earlier sat on vacation on January 27 to settle the dispute, where a dissenting judge had set aside the division bench's order that had quashed his direction. Along with directing a CBI investigation, the division bench had canceled the judge's direction to the central agency to proceed with the investigation.
In an effort to resolve the contentious judicial situation, the bench on Saturday decided to “take over” and stay all proceedings in view of the clash between two benches of the Calcutta High Court over the CBI probe into alleged irregularities. .
Justice Abhijit Gangopadhyay had accused division bench judge Soumen Sen of rejecting his order for a CBI probe to serve the interests of West Bengal's ruling party.
